Foundation Tournament Participation

Rules, Policies, and Registration Agreement

I, on behalf of myself and/or a minor for whom I am responsible as guardian, including,
in relation to acting as either caddie, player, or spectator, as applicable (hereinafter,
“Participant”), wish to participate in this Event organized by U.S. Kids Golf Foundation
(“Foundation”). In consideration and as a condition of Foundation permitting Participant
to participate in this Event, Participant hereby represents that Participant has read and
agrees to the terms, conditions, and representations contained in this Rules, Policies,
and Registration Agreement (“Agreement”). By completing registration for any
Foundation Event, including this Event, Participant agrees to be bound by the terms of
this Agreement.

The terms of participation are applicable to all Foundation Events, including this Event,
including all golf tournaments, camps, lessons, and other activities organized by
Foundation. By registering for this Event, Participant represents and warrants to
Foundation that Participant has full legal authority to complete this registration. In
addition, if Participation completes registration on behalf of any minors or others,
Participant represents and warrants that Participant has been dully authorized to act as
agent on behalf of such parties in performing this registration and that the minor or other
Participants on behalf of whom this Agreement is Agreement is made is aware of the
Agreement’s terms and conditions. By proceeding with this registration, Participant
agrees that the terms of this Agreement shall apply to Participant, any third parties for
whom Participant acts as agent, and any third parties present at the Event by reason of
Participant’s participation, including spectators and family members.

Participant’s Safety Obligations and Assumption of Risk

Safety is Foundation’s priority in any of its organized Events. Participants are
responsible for their own safety and for remaining conscious of the safety of other
participants on the course, practice areas, and during other activities related to the
Event. Participant acknowledges that his or her commitment to maintaining the safety of
Participant and others is a condition of participation in any Foundation organized Event.
Foundation may suspend or terminate Participant’s participation in Event if Foundation
determines that Participant is participating in an unsafe manner.

Participant understands that participation in athletic activities, by nature, involves a risk
of serious injury or death, including economic losses, which may result not only from
Participant’s actions, inactions, or negligence, but also from the actions, inactions, or
negligence of others, the natural condition of the facilities, the structural or maintenance
condition of any buildings at the host facility, equipment, vehicles or other machinery
present at the facilities, weather (including lightning, hail, hurricanes, and tornadoes),
and areas where the Event is being conducted, the rules of play, and this type of Event.
Participant further acknowledges that riding in golf carts (especially in conjunction with
pushing or pulling a separate push or pull cart) can cause serious injury or death and
agrees that, when riding in a golf carts, he or she will always read and obey the golf cart
manufacturer’s safety and operations notices and manuals. Participant agrees that
Foundation shall not be responsible for any bodily injury incurred in connection with, or
damages to equipment resulting from, Participant’s use of a golf push or pull cart in any
capacity, including in conjunction with riding in a golf cart.

Participant acknowledges and realizes the potential dangers of participating in such
activities and the Event, and fully assumes all risks associated participation in such
activities, including, without limitation, any and all risks of bodily injury to Participant,
including medical or hospital bills, permanent or partial disability, death, and damages to
Participant’s property, caused by or arising from participation in the Foundation Event
for which Participant is registering. Participant agrees to not hold Foundation or the
facility where the Event is held responsible for any lost or stolen items.

Participant (including Participant’s guardian) may discontinue play if Participant believes
there is danger of compromised safety to Participant or others, including because of
weather, illness, injury, or other reason. Participants are advised to seek shelter or
medical attention, as applicable, under any such circumstances. Notwithstanding the
foregoing, participant understands that weather conditions—including rain, fog, wind,
and extreme temperatures—that do not pose risk to health or safety, are not typically, in
and of themselves, proper reason for Participants to discontinue play and will not
generally result in Foundation suspending play.

Participant acknowledges that, except for any Events held at Longleaf Golf and Family
Club, the Event is hosted by a facility and on facility property that not owned or
maintained by Foundation and that Foundation is not responsible for maintaining any
physical or natural conditions or equipment, including golf carts, at the Event facility.

Participant warrants that Participant has been checked by a licensed physician prior to
attending the Event and that Participant is in good health and has no physical condition
that would prevent him/her from participating fully in the Event. In a case of emergency
during a Foundation Event or activity, Participant authorizes a qualified medical
physician or paramedic to take necessary measures in the treatment of the Participant.
Participant further authorizes personnel associated with Foundation or the host facility
to provide information to medical physicians or paramedics, as requested by medical
providers, in furtherance of any treatment occurring during a Foundation Event.

Release of Liability

Participant covenants not to sue or present any claim for personal injury, property
damage or theft, or wrongful death against Foundation, the host golf facility, or their
affiliates, or such parties’ respective officers, directors, trustees, employees, agents, or
representatives (including, without limitation, coaches) (collectively, the “Released
Parties”), for any loss of or damage to property, injury, or death suffered or incurred by
Participant or any other person while participating in, observing, or otherwise being
involved in the Event for which Participant is registering.

Participant hereby releases, waives, discharges, and relinquishes the Released Parties
from any liability, loss, damage, claim, demand, or cause of action of any and all kinds,
nature and character whatsoever, known or unknown, including, but not limited to, any
liability, loss, damage, claim, demand or cause of action arising out of or in connection
with the Released Parties’ negligence in connection with participation in the Event, with
the sole and singular exception that Participant does not release Released Parties of
liability arising out of their bad faith or willful misconduct.

Participant is hereby providing the Released Parties a general release of all claims,
present and future, that Participant (including any guardian acting on behalf of a minor
Participant, or by nature of that guardian’s familial or other relationship with Participant)
may have against the Released Parties. Participant understands that the granting of the
foregoing release and covenant not to sue is an express condition of Participant being
permitted to attend and participate in the Event.

Event Photo and Video Release

Photographers and/or videographers may have been assigned to this Event to capture
imagery that will be used for future promotion. Participant agrees to be included in
photographs and/or video clips used in news releases, website pages, brochures, flyers,
print, and television advertising, etc.

Participant grants Foundation, their advertising agencies, successors or assigns
permission and unconditional rights to use, print, publish or allow to be published,
Participant’s photographic image and/or likeness for any legal purpose, including for
promotional and/or advertising purposes, without compensation, restrictions, or
limitation whatsoever.

Prohibition Against Unfair Advantage in Competition

Participant agrees to not obtain an unfair advantage by any means in any competition
Event in which participation is based on, or categorized by, age and/or gender. Unfair
advantage includes taking of illegal drugs, performance-enhancing drugs, or hormone
treatments. Unfair advantage also includes participating in an age or gender group that
is not the congruent with the age and/or gender reflected by Participant’s birth certificate
issued at the time of Participant’s birth. Should a question arise to the gender or birth
date of any player, documentation associated with birth will be used and required to
support entry. Foundation reserves the right, at its sole discretion, to decide as to
whether a Participant has obtained an unfair advantage through this or any other
means.

Participant agrees to play fairly and to abide by these rules and policies and any rules or
other administrative determinations issued by Foundation or any rules official acting on
behalf of Foundation during or pertaining to an Event. Foundation reserves the right to
make all final determinations as to the rules, or violations thereof, any unfair advantage,
and all final determinations as to penalties or disqualifications resulting from a breach of
the applicable rules. Foundation retains the right to do whatever it deems necessary on
any subject manner related to an Event. This includes disqualification of a player for
violation of the rules and policies or any other reason and may result in prohibiting a
Participant, caddie, parent, or spectator from participating in the Event or future Events.

Choice of Law and Venue

If, for whatever reason, a dispute arises between Participant and Foundation arising out
of or related to this Agreement or arising out of or related to Participant’s participation in
any Foundation Event, this Agreement’s terms shall be construed in accordance with
the laws of the State of Georgia. And the state and federal courts sitting in and over
Gwinnette County, Georgia shall have exclusive jurisdiction over any such dispute.

Participation Rules and Policies

Rules of Event

Participant acknowledges that Participant (and as applicable, Participant’s caddie) is
responsible for reading, understanding, and abiding by the rules and policies applicable
to the Event, as posted on Foundation website and updated from time to time, which are
incorporated herein by reference. Those policies include Rules and Regulations, Pace
of Play Policy, Caddie Policy, Cart Policy, Playoff Policy, Dress Code Policy, and Entry
Cancellation (Refund) Policy. Some of these policies are reproduced below.

Caddie Policy, Rules, and Certification

A “caddie” is one who assists a Participant in participating in accordance with the rules
of golf, which includes carrying or handling the Participant’s clubs during play and
offering the player other assistance and advice, subject to the applicable rules of golf
and any additional Event rules governing any Foundation Event. Participants nine years
old and under are required to have a Caddie at least thirteen years old. All Participants
are encouraged to have caddies.

Foundation provides a Caddie Certification designed to help caddies understand their
role and responsibilities. Cadies are encouraged to become certified through Foundation’s program.

Foundation requires the highest standards of behavior from both caddies and
Participants to make all Events more enjoyable. Caddie conduct will be monitored by all
Foundation officials and by other caddies and participants in each group. Participant
acknowledges and agrees that every provision in this Rules, Policies, and Registration
Agreement applicable to Participant is applicable to Participant’s caddie. Participant
further represents and warrants that Participant’s caddie, if any, has read this
Agreement and agrees to be bound by its terms.

Caddies are strongly encouraged to be familiar with the rules of golf and to carry a
rulebook. Caddies are not, however, officials with the authority to make rule
determinations. Caddies acknowledge that if they are not sure of the proper procedure
in any given situation, they should call for the assistance of a rules official or, in cases
where an official is not available, arrange for the Participant to play a second ball in
accordance with USGA Rule 20.

The following additional guidelines, applicable to caddies, are provided to assist in
assuring golf is enjoyable for everyone. Caddies must:

  • Count Participants’ clubs before the start of the round to make sure there are not
    more than 14;
  • Avoid over-coaching Participants during play of rounds;
  • Adhere to all rules and guidelines provided by the USGA and Foundation;
  • Be as familiar as possible with the host facility and, especially the locations of
    teeing grounds for Participants;
  • Be familiar with order of play from the tee;
  • Ensure that Participants for whom they are caddying are in position to play when
    it is their turn;
  • Ensure that bunkers are raked, divots are replaced, and ball marks are repaired;
  • Replace the flagstick if their Participant is last to hole-out;
  • Stay aware of the group's pace of play and whether the group is out of position
    and/or over time-par;
  • Keep the score of the Participants for whom they are caddying and have it
    available upon conclusion of the round to double check the official scorecard;
  • Witness Participants’ signing of their fellow competitors’ scorecards and remain
    in the scoring area until all cards have been fully signed (noted that Participants
    are not responsible for addition on the scorecard, only the accuracy of the score
    on each hole);
  • Keep a positive attitude and help Participants remain positive.
  • Participant plays each shot within a reasonable amount of time (and, in all cases,
    within the timeframe required by the applicable rules); and
  • Refrain from “over-coaching” Participant.

Caddies must not be disruptive to any other participant or caddie. Caddies that become
disruptive will, in most circumstances, first be warned of the problem. Any subsequent
disruptive behavior may result in Participant and/or Participant’s caddie being removed
from the Event. Foundation, through its officials, agents, and tournament directors,
reserves the right to dismiss any caddie for disruptive behavior. Caddies that are
dismissed from any single Event will generally be prohibited from acting as caddies in
any subsequent Event for the twelve months following dismissal.

Pace of Play for Participants and Groups

Participant agrees to abide by Foundation’s Pace of Play Policy, as updated from time
to time on Foundation’s website. Participant agrees to play without causing undue
delay, which is defined as taking no more than 45 seconds to play a shot once
Participant has arrived at Participant’s ball. Participants who are first to play from a
given area (tee, fairway, green, etc.) will have ten extra seconds to play their shot.
Within the context of play within a group (i.e., twosome, threesome, or foursome),
Participant acknowledges that Participant’s group will be required to maintain “time par.”
Time par is met by a group if it meets either of the following conditions: The group (1)
completes each hole in an average of 15 minutes; or (2) keeps up with the group
playing in front of it.

Foundation retains the exclusive right to evaluate pace of play and determine whether a
group is keeping up with time par. Group’s falling out of pace of play will be deemed out
of position and be warned and asked to speed up play. If the group continues to fall
behind, each Participant in the group will be timed individually. Individual Participants
who take more than the allotted time may then be subject to a penalty. A first offense
will result in a warning; a second offense will result in a one stroke penalty; and
subsequent offenses will result in scores of ten on each hole during which Participant
fails to play within his or her allotted time. The 45-second rule is in place to assure
playing without “undue delay” and to prEvent over-coaching and slow play.

Code of Conduct for Parents and Spectators

Parents, caddies, and spectators have a great influence on children's enjoyment and
success in golf as well as other sports. Foundation strives to enable all its Participants
to enjoy the game. Positive encouragement and support from adults and siblings will
allow everyone to enjoy the youth sports experience and help build positive lasting
memories.

Therefore, Foundation Participants, Participants’ Parents, caddies, and spectators shall:

  • Make every effort to bring Participants to tournaments on time and to get them to
    the tee 10 minutes before their tee time;
  • Ensure that Participants are prepared to play, including by having balls, tees, and
    other necessary equipment;
  • Promote fair play and never condone unsporting behavior contrary to the game
    of golf;
  • Encourage and guide Participants to accept responsibility for their own behavior
    and performance;
  • Commit to participating fully in Events for which Participants are registered;
  • Understand that withdrawing from Events, especially mid-Event, impacts other
    Participants;
  • Applaud, compliment, and enjoy good play all Participants, including competitors;
  • For non-caddie parents and spectators, refrain from coaching Participants or
    carrying their equipment;
    Respect decisions by rules officials and develop an understanding of the rules of
    golf;
  • Place the well-being, safety, and enjoyment of Participants above all other
    considerations, including performance and results;
  • Not use or tolerate inappropriate language;
  • Adhere to all the guidelines laid down by Foundation and the host facility; and
  • Enjoy kids learning and the game of golf.

    Cancellation Policy

    Participant acknowledges that Foundation reserves the right, at its sole discretion, to
    cancel or shorten any Foundation Event. All tournament cancellations are subject to
    processing fees. All Foundation Events are subject to the Refund Policy, as stated on
    Foundation’s website at the time of Event. Events that are completed but shortened due to weather conditions or other circumstances beyond the control of Foundation are not subject to any refund.

    Rules Subject to Change

    The terms of this Agreement, including the policies and rules incorporated herein, are
    subject to change, as amended from time to time on Foundation’s website. If there is
    any conflict between the rules and policies stated herein and those contained on the
    Foundation’s website, the rules and policies stated on the website shall control.
